Usage Agreement (Terms of Service)

1. Scope and Purpose
This Usage Agreement governs access to and use of Overctrl, an analytics and insights platform with social features in development, provided as a beta service.
By accessing or using Overctrl, you agree to be bound by this Agreement.
If you do not agree, you must not use the service.
2. Description of the Service
Overctrl provides analytics, insights, and aggregated views related to software repositories and ecosystem activity, primarily based on publicly available GitHub data.
The service is currently:
- Free of charge
- In beta / experimental stage
- Subject to change at any time
Paid plans may be introduced in the future.
3. Access and Availability
Access to Overctrl:
- Is provided on an “as is” and best-effort basis
- May be revoked or restricted at any time
- Is not subject to any uptime or availability guarantees
Features may be modified, suspended, or discontinued at any time.
4. Accounts and Authentication
Access requires authentication via GitHub OAuth.
You are responsible for:
- Maintaining the confidentiality of your account
- All activities performed through your account
5. Suspension and Termination
Access to Overctrl may be suspended or terminated, in particular in cases of:
- Abuse or misuse of the service
- Violation of this Agreement
- Legal or regulatory risk
- Actions taken at Overctrl’s discretion to protect the service or third parties
Where reasonable, users may request a review or appeal of suspension decisions.
6. User Obligations and Restrictions
You agree not to:
- Scrape, crawl, or harvest data from Overctrl
- Use automated systems beyond reasonable, intended usage
- Circumvent rate limits or technical restrictions
- Reverse engineer, decompile, or attempt to extract source code
- Interfere with the integrity or security of the service
Sharing and Reuse
You may share content or insights from Overctrl for non-commercial purposes, provided that:
- Overctrl is clearly credited as the source
Commercial use of Overctrl data is not permitted unless explicitly authorized.
7. GitHub Data and Attribution
Overctrl processes data obtained from public GitHub APIs.
Overctrl is not affiliated with, endorsed by, or sponsored by GitHub.
GitHub content is displayed as part of aggregated views and analytics.
8. Intellectual Property
All rights to:
- The Overctrl platform
- User interface
- Code
- Branding and design
are owned by the operator of Overctrl.
User-submitted content features may be introduced in the future. Ownership and licensing terms for such content will be defined at that time.
9. Insights and Disclaimer of Responsibility
All analytics, signals, and insights provided by Overctrl are:
- Informational only
- Provided without warranty of accuracy or completeness
You acknowledge that Overctrl is not responsible for decisions made based on:
- Repository health indicators
- Dependency analysis
- Security-related interpretations
- Business, financial, or technical decisions
Use of the service is at your own risk.
10. Beta Status
Overctrl is provided as a beta / experimental service.
You acknowledge that:
- Bugs and errors may occur
- Data may be incomplete or inaccurate
- Features may change or break without notice
11. Pricing and Changes
Overctrl is currently free.
Pricing models, paid plans, or usage limits may be introduced in the future.
This Agreement may be updated unilaterally. The current version will always be made available on the website.
12. Liability
To the maximum extent permitted by German law:
- Overctrl is provided “as is”
- No warranties are given
- Liability is limited to intent and gross negligence
Liability for slight negligence is excluded, except where mandatory by law.
13. Governing Law and Jurisdiction
This Agreement is governed by the laws of Germany.
The place of jurisdiction shall be Germany, unless mandatory consumer protection rules require otherwise.

15. Severability
If any provision of this Agreement is held invalid, the remaining provisions remain effective.
